NAFTA’s Chapter 11: Investor Protection, Integration and the Public Interest
In this paper Julie Soloway examines the importance of foreign direct investment, both inward and outward, for Canada, particularly in terms of Canada’s relationship with the United States. She argues, however, that the parties to NAFTA did not contemplate the degree of social and economic integration that would occur between the member countries when NAFTA was signed, and thus NAFTA’s failure to address the challenges of these conditions was built into its institutions.
