Telmex Panel Strips WTO of Another Fig Leaf

In April 2004, the World Trade Organization (WTO) ruled in favour of the US against how Mexico regulates Telmex, the country’s major telecommunications supplier. In this brief report, Ellen Gould examines this dispute panel ruling in which the US successfully claimed that Mexico was violating the General Agreement on Trade in Services (GATS). According to Gould, the panel’s interpretation of GATS provides a cautionary tale for governments who believe they can preserve their policy space while taking on more WTO obligations.

As Gould points out, the WTO panel dismissed Mexico’s arguments that in order to be granted access to the Mexican market, American firms should have to help develop the country’s telecommunications infrastructure. Gould contends that the panel’s decision is particularly negative for developing countries: since virtually no developing country has the capacity to increase its participation in international trade in telecommunications services -- a clause set out in the WTO provision, in order to receive the benefit of GATS provisions. In the author’s view, the decision provides zero benefit to developing countries.
